Second trial begins for former DMPD officer

The second criminal trial for a former Des Moines police officer accused of inappropriately kicking a suspect in the head started Monday morning at Des Moines' federal courthouse.

Colin Boone, 38, faces a charge of unreasonable use of force. Boone was indicted in 2013 after the then-400 pound officer kicked Orville Hill in the head during a traffic stop, causing an injury that required stiches. Hill lost two front teeth from the kick.

It's the second trial in the case after a deadlocked jury in November couldn't decide whether the officer violated Hill's civil rights. Jurors found Boone "not guilty" on a charge of falsifying records, stemming from accusations that Boone failed to include the kick in an official incident report.

Federal prosecutors submitted a list of 18 witnesses who could testify at the trial, including Hill and 11 members of the Des Moines Police Department. Boone's defense attorney has a list of 17 witnesses that includes 10 police department members.

Hill filed a lawsuit against in February against the department and Boone, claiming the police department lacked policies on how multiple officers should restrain a suspect. The lawsuit seeks monetary damages.
